Mr. Leavitt represents and advises individuals and businesses in employment, litigation, and tax controversy matters.

Biography

Mr. Leavitt defends large and small businesses against charges of discrimination, retaliation, and wage and hour claims.  He has represented clients who are being audited and investigated by numerous federal and state agencies, including the EEOC, NLRB, Attorney General’s Office, AZDES, and the IRS.  Mr. Leavitt has also represented individuals and companies in litigation arising from a variety of employment issues, including restrictive covenants, misappropriation of trade secrets and confidential information, tortious interference, and defamation.  Finally, Mr. Leavitt also advises employers regarding their employment policies, handbooks, and other day-to-day employment needs.

Mr. Leavitt represents individuals and businesses in tax controversy matters.  He defends his clients in IRS audits, from the examination period through Tax Court and assists taxpayers in collection matters by negotiating Offers in Compromise and/or Installment Agreements with the IRS.  Mr. Leavitt also represents taxpayers before the Arizona Department of Revenue on various matters, including collections, examinations, and the transaction privilege tax.

In addition to the practice areas above, Mr. Leavitt has experience litigating all types of disputes, including tort defense, breach of contract, real property disputes, and probate litigation.  He represents clients in all phases of litigation, including motion practice, mediation, arbitration, trial, and appellate proceedings.

Employment

  • Represents employers before administrative agencies against charges of discrimination and retaliation
  • Represents employers in court against wage and hour claims
  • Represents employers in worker classification audits before the IRS and DES
  • Represents employers and employees in litigation involving trade secrets, restrictive covenants, and defamation.
  • Advises clients on employment matters, including revising employee handbooks, drafting policies and restrictive covenants
  • Defended a contractor and its owner from a wage claim asserted by a former employee. Obtained complete defense verdict after bench trial.
  • Defended a hotel owner against collective wage and hour lawsuit filed by former employees. Settled on favorable terms.
  • Defended contractors from a former worker asserting a racketeering claim based on wages. The Court granted the motion to dismiss.

Tax Controversy

  • Represents taxpayers in audits before the IRS, including representing taxpayers during examination, appeals, and in Tax Court.
  • Represents taxpayers in collection matters before the IRS
  • Represents taxpayers in audit and collection matters before the Arizona Department of Revenue
  • Successfully reduced a taxpayer’s outstanding balance by six figures based on an offer in compromise based on doubt as to liability.

General/Commercial Litigation

  • Represents public utility in tort defense matters and has prevailed on dispositive motions on several occasions
  • Represented plaintiffs in a lemon law claim against a major car company. Acted as second chair and obtained a complete plaintiffs’ verdict after a jury trial.
  • Defended individuals in breach of contract and conversion claims against a neighbor. Successfully defended the claim at arbitration and obtained an award for attorney’s fees.
  • Represented a personal representative of an estate on appeal related to an award of attorneys’ fees. Successfully briefed and argued before the Arizona Court of Appeals.
