Ms. Roby is Chair of the firm’s Energy Practice Group and has over 15 years of electric utility experience practicing before the Federal Energy Regulatory Commission (FERC), state utility commissions, and in related court proceedings. Much of Ms. Roby’s work focuses on the generation and transmission of electric power, investment in transmission infrastructure, development of energy markets, and Regional Transmission Organizations. Her clients include state utility commissions, individual municipal electric systems, municipal agencies, and electric generation and transmission cooperatives throughout the United States for which she provides legal advice and litigation services on a variety of energy-related issues.

Ms. Roby is active in project development, including new hydroelectric projects and other renewable resources. Much of this work involves state and federal agency interaction concerning environmental and project operations compliance, the development of project participation agreements, and power purchase and sale agreements. Ms. Roby is also actively engaged in matters involving compliance with reliability standards developed by the North American Electric Reliability Corporation (NERC).

Ms. Roby is listed as a Washington D.C. Super Lawyer (2012 – 2017) by the publishers of Law & Politics Magazine.

Representative Engagements

  • Represents a State Utility Commission in a variety of FERC proceedings

  • Represents municipal utilities who are Transmission Owning members of Regional Transmission Organizations

  • Assisted in the integration of municipal utilities into Regional Transmission Organizations, including establishment of transmission revenue requirements in existing pricing zones, negotiating joint transmission pricing zone agreements, and related FERC litigation

  • Represented a large Generation & Transmission Electric Cooperative in its integration into PJM as a Transmission Owner, including the establishment of a new transmission pricing zone in PJM

  • Represents wholesale purchasers of power in proceedings at FERC in which key terms of pricing and service are established for gneration, transmission and ancillary services

  • Prosecuted complaint before FERC alleging abuse of market power by an investor-owned utility

  • Represents federal hydropower licensees before FERC concerning hydropower licensing and development, and concerning environmental and compliance issues

  • Counseled a municipal utility involving a breach at the utility's hydropower facility and subsequent rehabilitation of the structure to meet regulatory requirements

  • Counsels several entities involving NERC compliance and enforcement

  • Represented affected unit of local government before the Nuclear Regulatory Commission in the licensing of a deep geologic repository for high-level nuclear waste at Yucca Mountain

  • Represents municipal utilities and state utility commissions in appellate court proceedings involving challenges of FERC orders, power supply contract disputes, environmental regulations, and other matters
